Terms of Service

1. Acceptance of Terms
By accessing or using StampKE ("the Platform"), operated by StampKE Solutions, Nairobi, Kenya, you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, you must not use the Platform.
2. Eligibility
You must be at least 18 years old and legally capable of entering into contracts under Kenyan law. By creating an account, you confirm that all information you provide is accurate, current, and complete.
3. Services Description
StampKE provides: (a) Digital Business Cards with QR codes and NFC support, (b) Client Capture & Lead CRM tools, (c) E-Signature & E-Stamp document management, (d) QR-Based Review & Feedback collection, (e) Meeting Booking & Scheduling, and (f) Email Signature generation. We reserve the right to modify, suspend, or discontinue any feature at any time.
4. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account digital business cards.
- You must not share your account or allow unauthorised access.
- You must immediately notify us of any suspected unauthorised use at support@stampke.co.ke.
- You are responsible for all activity that occurs under your account.
5. Acceptable Use
You agree NOT to:
- Use the Platform for illegal, fraudulent, or harmful purposes.
- Upload malicious files, viruses, or exploits.
- Impersonate another person or entity.
- Attempt to gain unauthorised access to other accounts or systems.
- Scrape, crawl, or harvest data from the Platform without permission.
- Use the e-signature features to forge or falsify documents.
- Violate any applicable Kenyan or international law.
6. Subscriptions & Payments
Certain features require a paid subscription. Payments are processed via Paystack in Kenyan Shillings (KES). Free trials last 30 days unless otherwise stated. Subscriptions renew automatically unless cancelled. Refund requests must be submitted within 14 days of charge. We reserve the right to change pricing with 30 days' notice.
7. Intellectual Property
- Our IP: All software, designs, trademarks, and systems are the intellectual property of StampKE Solutions.
- Your Content: You retain ownership of content you upload (photos, documents, business details). By uploading, you grant us a limited licence to process and display it as necessary for service delivery.
- E-Signatures: Signed documents remain your property. We do not claim rights over your signed documents.
8. Data Protection & Privacy
Your use of the Platform is also governed by our Privacy Policy. We process personal data in accordance with the Kenya Data Protection Act, 2019 and applicable international standards.
9. E-Signature Legal Validity
Electronic signatures created through StampKE are intended to comply with the Kenya Information and Communications Act and relevant electronic transaction laws. However, StampKE does not guarantee that e-signatures will be accepted in all jurisdictions or for all document types. Users are responsible for ensuring compliance with applicable laws for their specific use case.
10. Limitation of Liability
To the maximum extent permitted by Kenyan law: StampKE is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for third-party service outages (Paystack, Resend, Vercel).
11. Termination
Either party may terminate at any time. You may delete your account via the dashboard or by contacting us. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be handled per our Privacy Policy retention schedule.
12. Governing Law & Disputes
These terms are governed by the laws of the Republic of Kenya. Disputes shall first be resolved through good-faith negotiation, then mediation, and finally through the courts of Nairobi, Kenya.
13. Changes to Terms
We may update these terms with 30 days' notice via email or website notice. Continued use after changes constitutes acceptance. Material changes will be clearly communicated.
